The Divorce, Dissolution and Separation Act 2020, will not come into effect until Spring 2022.

There will be an end to the blame game for couples facing divorce. Currently, those wishing to divorce cannot end their marriage unless they wait 2 years (if both consent) or five years (if one does not consent) or where each person blames the other for the breakdown of their marriage.

From Spring 2022, couples can apply for a ‘divorce order’ on the basis that the marriage has broken down irretrievably and neither person in the marriage will have to blame the other.

Both parties will have to wait twenty weeks before applying for a conditional order, or Decree Nisi to allow time for reflection.

If the path of divorce is agreed upon, the couple can apply for the conditional order, and then six weeks thereafter for the final order or Decree Absolute. #divorce #separation #decreeabsolute
