Wills
We often deal with people who do not have knowledge of the effect that their death would have upon their family in financial terms. Some people assume that if they die without a Will their estate will always automatically pass to their spouse. This is not necessarily so as there is legislation which sets out a list of persons who will benefit from your estate and in what proportions. An example of this is that if you pass away without a Will and you leave a spouse and children then if your estate is worth more than £250,000 it may not all pass to your spouse, even if that is your wish.
We endeavour to offer you the security that your estate will be shared amongst those who you wish to receive it and we also assist in the appointment of guardians for minor children, gifts to individuals and charities and any funeral wishes you may have.
We offer a fixed price for wills of £100 plus VAT for all basic wills. For complicated wills an individual quote will be given upon consultation.
Probate & Estate Planning
If you have been appointed to act as an executor under a will or if you wish to administer a relative’s estate then we are able to assist you with the legal formalities. We endeavour to offer very clear advice in a sympathetic manner in what is normally a very difficult time for the executors and the beneficiaries.
We strive to make this process as stress free as possible for our clients and offer a fixed fee for our probate work which often assists the estate in the knowledge that they will not receive an unexpected large legal bill. Our fixed fees are 1.5% of the value of the estate. For example if your relative’s estate is £100,000 you would pay fees of £1,500 plus VAT.
The initial consultation will also include any third party costs which may arise as a result of the particular wishes of the deceased and other court fees applicable.
Please note these charges will not apply if the estate has a foreign asset, if the will is contested or if considerable work needs to be undertaken to trace beneficiaries.
We also offer advice in the planning of your estate in order for the creation of trusts or other legal documents which will assist the beneficiaries in achieving the maximum benefit from their loved ones estate. Important issues such as inheritance tax and capital gains tax which arise from any such estate planning are usually at the forefront of such advice.
